Terms of Conditions

In the following Terms and Conditions, Bauhinia Solutions is referred to as “Bauhinia”, and you, the client is referred to as “the client”.

1. Amendments
Bauhinia reserves the right to change our terms and conditions at any time, at which time a notice will be posted on our blog advising of such changes. The following Terms and Conditions apply to all products and services provided by Bauhinia.

2. Acceptance of Terms and Conditions
All work is carried out by Bauhinia with the understanding that the Client has read, understands and agrees to be bound by Bauhinia Terms and Conditions. If the pay-by-the-month payment plan is in place, the contract terms and conditions are applicable.

3. Quotations
Upon requesting a quote, you, the Client will be sent a written confidential quotation in electronic format. The quote will outline the costs for services requested, additional expenses such as printing, couriers etc and will include an estimated time-frame of delivery.

All quotes are valid for 30 days and are subject to change should the scope of requested work change, or if additional resources are necessary. Any changes to quotes will be in complete consultation with the client.

Additional expenses such as phone calls on behalf of the Client, postage, couriers, colour printing, facsimiles, etc are charged separately and will be itemised on the final bill. We will ensure that additional expenses are approved by the Client prior to utilising such services.

Urgent requests or after-hours work is subject to a 20% surcharge.

4. Acceptance of Quotation
Acceptance of quotation must be emailed sent to Bauhinia and is legally binding. All work will be prioritised based on a ‘first come, first served’ basis.

Bauhinia does require a non refundable deposit before commencement of work, unless otherwise stated. For all work between HKD800 and HKD2999, the deposit is 15% of the quotation price. For all work greater than HKD2999, the deposit is 30%.

For regular, ongoing work the deposit is waivered after the first month of continued work.

This is payable by cheque or direct deposit into a Hong Kong bank. Please reference this quote number when making your payment.

Payment details are given upon acceptance of the quotation.

5. Changes of Work Request
For all work other than web and graphic design, all additional changes to the original, agreed upon work request will be submitted for approval prior to moving forward.

For website and graphic design work, all additional changes are subject to a charge of HKD400 per round. A round of changes is defined as a single or several changes given at one time.

6. Design and Development
During the design and development process, it is expected that you, the Client will work with Bauhinia to reach the results outlined in the service provided or outlined quotation. This includes providing timely feedback, as well as a willingness to clarify and elaborate on details as required.

All artwork supplied remains the copyright of Bauhinia until final payment of your account has been made. After which, full copyright is owned by you, the Client.

Any discarded concepts, ideas, designs and/or code remain the property of Bauhinia, and must not be used by the Client under any circumstances, unless purchased separately.

The Client grants explicit permission for Bauhinia to use above-mentioned final components for self-promotional purposes. While Bauhinia takes all care to ensure error-free documents and designs, it is the responsibility of the Client to notify Bauhinia of any errors or omissions prior to finalisation of the account. Changes after finalisation of accounts will incur a separate fee.

7. Confidentiality
We value you as a client and take confidentiality seriously. All information provided by the Client is used solely for the purpose of completing the work. Your information will not be passed on to any third party. We are happy to sign a confidentiality agreement, if necessary.

8. Invoicing
All invoices are charged in Hong Kong Dollars unless otherwise stipulated and are to be paid within 7 working days from date of invoice.

We accept payment via PayPal or Direct Deposit into a Hong Kong bank. Business and Bank Cheques are accepted, however if returned, the client will be charged the return fee. Overdue accounts may be subject to a late fee of $100 HKD.

8. Withdrawal of Services
Bauhinia reserves the right to withdraw their services at any time with a full refund of your deposit.
